  1. PURPOSE
These General Terms and Conditions govern the purchase of training courses and products offered on the website magnetictape.info, owned by MAGNETIC TAPE, SLU (hereinafter, Magnetic Tape). The purchase of any of the products implies full and unreserved acceptance of each and every one of the General Terms and Conditions indicated, without prejudice to the acceptance of any Specific Terms and Conditions that may apply when purchasing certain products. These General Terms and Conditions may be modified without prior notice, therefore, it is advisable to read their content carefully before proceeding with the purchase of any of the products offered.

To communicate with us, we provide you with various means of contact, which are detailed below: Email: ventas@themagtape.com. All notifications and communications between users and Magnetic Tape shall be considered effective, for all purposes, when made through any of the means detailed above.
  1. SERVICES AND PRODUCTS
The services and products offered, together with their main characteristics and prices, are displayed on screen. Magnetic Tape reserves the right to decide, at any time, the products and/or services offered to Customers. Thus, Magnetic Tape may, at any time, add new products and/or services to those currently offered. Likewise, Magnetic Tape reserves the right to withdraw or cease offering, at any time and without prior notice, any of the services offered. Once inside magnetictape.info, and in order to access the contracting of the various services and/or products, the User must follow all the instructions indicated in the purchase process, which will involve reading and accepting all the general and specific conditions set out in magnetictape.info.
  1. AVAILABILITY AND SUBSTITUTIONS
SERVICES For the provision of online course services, Magnetic Tape will provide access as follows: the customer will be provided with a username and password to access the e-learning classroom. Magnetic Tape shall not be liable for any damages that may be caused to said USER as a result of failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the magnetictape.info service during its provision. For the provision of face-to-face course services, Magnetic Tape will publish a questionnaire where interested users can enter their details and the city where they wish to take the course. Subsequently, it will publish the editions with all the necessary information for making the payment, as well as the dates, times and venue, together with the syllabus and duration. If the face-to-face course has to be cancelled or postponed for any reason, Magnetic Tape will give at least one week’s notice to inform students, who will be given the option of a refund or enrolment in the next edition if they wish. Magnetic Tape shall not be liable for any damages or losses that may be incurred by said USER as a result of events of force majeure, organisational or personal events that cause the suspension, cancellation or interruption of face-to-face training. Every effort will be made to resume training whenever possible. PRODUCTS Magnetic Tape aims to guarantee the availability of all products advertised on magnetictape.info. However, in the event that any product requested is unavailable or out of stock, the customer will be informed as soon as possible via the email address used during the purchase. If the product is unavailable and the consumer has been informed of this, Magnetic Tape may supply a product with similar characteristics at no extra cost, in which case the consumer may accept or reject it by exercising their right of withdrawal and termination of the contract. In the event of total or partial unavailability of the order, and the customer’s rejection of the replacement products, the refund previously paid will be made using the same payment method used for the purchase. If Magnetic Tape is unjustifiably delayed in refunding the amounts paid, the consumer may claim double the amount owed.
  1. PURCHASE AND/OR CONTRACTING PROCESS
To make any purchase on magnetictape.info, the customer must be of legal age. The steps to follow to make a purchase are:
  1. Select the products you wish to add to your basket.
  2. When you are finished, go to your basket to check your purchase.
  3. Add or remove products as you wish.
  4. Once you are finished, proceed to the payment process and, if applicable, shipping.
Customers can access their previous purchases by logging into their user account. It is also advisable for the customer to print and/or save a copy of the terms and conditions of sale on a durable medium when placing their order, as well as the proof of receipt sent by Magnetic Tape by email. COMMENTS You may also request a copy of your invoices by sending an email to customer service at ventas@themagtape.com. INVOICING You will receive the corresponding invoice along with your order. To this end, the customer agrees to receive said invoice in electronic format. The customer will receive it in their email account once the purchase has been confirmed. You may revoke this consent at any time by sending an email to customer service to receive a paper invoice. DURATION This will be specified in the product description for the training course purchased. RENEWAL Training courses have a fixed duration, which cannot be extended. CANCELLATION Training courses cannot be cancelled once they have started. You may also request a copy of your invoices by sending an email to customer service.
  1. DELIVERY
SERVICES The service will be provided as follows: The service will be provided through access to a virtual classroom that will be available to the student from the start of the course until its completion. They will be able to access it at any time during this period using the user account and password provided at the time of purchase. PRODUCTS The order will be delivered to the address designated by the customer at the time of purchase, according to the chosen delivery method. The delivery area covers the following zones: Spanish national territory, other territories upon request. DELIVERY METHODS AND TIMES

The maximum delivery time for access to the platform is 4 days, counting only working days. Access to the course content will usually be effective on the day the course begins.

  1. PRICES, COSTS AND TAXES
The prices of the products and services listed on magnetictape.info will be expressed in euros unless otherwise stated and will be guaranteed during their period of validity, except in the case of printing errors and regardless of the destination of the order. PRODUCTS AND SERVICES The final prices of all products and services (and, where applicable, the final prices per unit of measurement, where mandatory) together with their characteristics, offers, discounts, etc., are reflected in each of the items appearing in the magnetictape.info catalogue.
  • Products include VAT.
  • The VAT rate is 21%, except for bandages, which are 10%, and books, which are 4%.
  • Shipping costs: shipping costs will be provided when the customer completes the shopping cart items and provides us with their shipping address, always before finalising the purchase.
The prices of products and services may vary at any time. In this case, the price to be applied will be the one in force on the date the order is placed. In any case, the final cost will be communicated to the customer during the online purchase process before they confirm their acceptance.

You can make immediate payment through our Bank’s secure SSL payment gateway. If it is necessary to make any refund or cancellation of the order, the amount will be refunded through the same payment card.

You can make immediate payment via Bizum through our bank’s secure payment system. If it is necessary to make any refund or cancellation of the order, the amount will be refunded via the same payment method or by bank transfer.

You can make immediate payment via PayPal. If it is necessary to make any refund or cancellation of the order, the amount will be refunded via the same payment method or via bank transfer.    
  1. RETURNS AND WITHDRAWAL POLICY
In accordance with the regulations, consumers and users have the right to WITHDRAW from the contract within a maximum period of 14 calendar days without having to give a reason and without incurring any costs, except those provided for in Articles 107.2 and 108 of Royal Decree 1/2007 of 16 November, which approves the aforementioned text of the General Law for the Defence of Consumers and Users. This right of withdrawal does not apply, among other things, to:
  • Provision of services already performed or commenced.
  • Supply of sealed goods that cannot be returned for health or hygiene reasons.
SERVICES The deadline for withdrawing from the service provision contract is 14 calendar days from the date of conclusion of the contract. The user must inform Magnetic Tape of their wish to exercise this right by completing the form at the end of this document. Exercising the right of withdrawal will result in the suspension of the service. Magnetic Tape will provide the consumer with a durable medium acknowledging receipt of said withdrawal. Withdrawal means that Magnetic Tape will refund the amount already paid by the customer within a maximum period of 14 calendar days, using the same payment method chosen by the customer (provided that the service contracted is not one of the exceptions indicated above). Once we receive your request, we will contact the customer to provide details of the refund. PRODUCTS The customer will have a maximum period of 14 calendar days from the date of receipt of the requested goods or product to inform Magnetic Tape of their desire to withdraw from the contract. Withdrawal means that Magnetic Tape will refund the amount already paid by the customer within a maximum period of 14 calendar days, using the same payment method chosen by the customer (provided that the product purchased is not one of the exceptions indicated above). During this period, the consumer shall notify Magnetic Tape of their decision to withdraw from the contract by filling in the form at the end of this document and sending it to Magnetic Tape’s email address. Magnetic Tape shall provide the consumer with a durable acknowledgement of receipt of said withdrawal. In order to return a product, it is essential that it is in perfect condition and in its original packaging, with all its accessories and without having been used. Once we receive your request and check the condition of the product, we will contact the customer to provide details of the return. The customer shall bear the costs of returning the goods.
  1. LEGAL GUARANTEE OF CONFORMITY WITH THE GOODS
Products purchased through magnetictape.info are covered by a 3-year warranty period. The trader shall be liable for any lack of conformity existing at the time of delivery or supply and which becomes apparent within three years of delivery in the case of goods. This warranty period shall apply only to the extent permitted by the nature of the goods. For durable goods, the consumer shall be entitled to adequate technical service and the availability of spare parts for a minimum of 10 years from the date on which the product ceases to be manufactured, without the price of spare parts being increased when used in repairs. Goods delivered by the trader to the consumer or user shall be deemed to be in conformity with the contract when they meet the applicable subjective and objective requirements, provided that, where applicable, they have been correctly installed or integrated, without prejudice to the rights of third parties referred to in Article 117 of the General Law for the Protection of Consumers and Users. Consumable products, deficiencies caused by misuse or tampering, or defects arising from any external cause are excluded from the guarantees. To avoid problems with the installation or use of the purchased product, ensure that you have followed the installation and operating instructions contained in the user manuals. If, even so, the purchased product does not work properly, you should immediately contact the manufacturer’s customer service and technical support, or, where applicable, the representative or distributor. Technical services will usually require you to provide the following information:
  • Invoice number.
  • Identification of the specific model.
  • Serial number.
  1. RESPONSIBILITY OF THE BUSINESS AND RIGHTS OF THE CONSUMER AND USER
The trader shall be liable to the consumer or user for any lack of conformity existing at the time of delivery of the goods, and the consumer or user may, by means of a simple statement, require the trader to remedy the lack of conformity, reduce the price or terminate the contract. In any of these cases, the consumer or user may also claim compensation for damages, if applicable. The consumer or user shall have the right to suspend payment of any outstanding portion of the price of the purchased goods until the trader complies with the obligations set out in this title. The consumer and user has the right to repair the product, to its replacement, to a price reduction or to the termination of the contract, as established in Chapter II, Title IV, Book II of the General Law for the Defence of Consumers and Users. If the product does not comply with the contract, the consumer may choose between repair or replacement of the product, both of which shall be free of charge to the consumer and shall be carried out within a reasonable period of time depending on the nature of the products and the purpose for which they were intended. If, after the repair has been completed and the product delivered, it still does not comply with the contract, the consumer may demand its replacement, a price reduction or the termination of the contract.

Information for consumers and users on the right of withdrawal

Right of withdrawal You have the right to withdraw from this contract within fourteen calendar days without giving any reason. The withdrawal period will expire fourteen calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired physical possession of the goods.
